Can I File Documents Online With Immigration Court?

What EOIR Respondent Access can do, which file types are accepted, and why upload confirmation is not the same as final acceptance.

For eligible cases, EOIR's Respondent Access Portal allows people in immigration proceedings to electronically file case-related documents instead of filing everything at the court window.

File types and size limits

EOIR currently states that Respondent Access accepts PDF, PDF/A, JPG, and JPEG files up to 25 MB. EOIR recommends black-and-white or grayscale scanning when possible to reduce file size.

Physical evidence that cannot be converted into a document must follow the court's non-electronic filing process.

Uploading is not the final step

After you upload a document, check its filing status. EOIR sends one email confirming receipt and another stating whether the document was accepted or rejected.

If accepted, the document is added to the electronic Record of Proceeding. If rejected, the notice should explain the reason.

Keep your own proof

Save:

  • the exact PDF or image you uploaded;
  • the upload date and time;
  • any confirmation screen;
  • the EOIR receipt email; and
  • the acceptance or rejection email.

Do not delete these after a successful upload. They are part of your filing history.

Deadlines still matter

Electronic filing does not eliminate filing deadlines. EOIR states that immigration-court filings must be submitted before midnight in the time zone where the hearing is scheduled. Different rules apply to BIA filings.
