Not every immigration-court record is available as an electronic eROP.
EOIR explains that when a case record is maintained only on paper, the Request Download button in Respondent Access is disabled. In that situation, the person must use the process for requesting a paper Record of Proceeding.
Do not treat a missing download button as a missing case
The absence of an electronic download does not necessarily mean no case file exists. It may mean the official record is still maintained on paper.
Build your own parallel file
While working to obtain the official ROP, keep your own complete case file with copies of:
- Notice to Appear;
- hearing notices;
- forms and applications;
- evidence submissions;
- proof of filing;
- court orders and decisions;
- attorney correspondence; and
- government correspondence.
When the official copy arrives
Compare your personal file against the official ROP. Make a list of anything that appears in one but not the other and discuss material differences with your attorney or accredited representative.
