What Do I Do if I Move While My Immigration Court Case Is Pending?

Why updating EOIR quickly matters, which change-of-address form may apply, and what records to keep.

If you have a pending case before an immigration court or the Board of Immigration Appeals, keeping your contact information current is critical.

EOIR currently states that address or contact-information changes must be provided within five working days of the change.

Immigration court versus BIA

For a case before an immigration court, EOIR uses Form EOIR-33/IC. For a case before the BIA, EOIR uses EOIR-33/BIA. Respondent Access may also allow the change to be completed online.

If more than one family member has a separate pending case, EOIR states that a change form must be submitted for each person.

Keep proof of the update

Save:

  • a copy of the completed form;
  • submission confirmation;
  • mailing or delivery proof if filed on paper;
  • screenshots if completed online; and
  • the date the address actually changed.

Moving does not automatically move your court case

EOIR explains that a person who moves may need a separate motion to change venue. Filing such a motion does not excuse attendance at already scheduled hearings unless and until the motion is granted.
