How do I create a witness list for attorney review?

A practical way to prepare a witness list for an immigration attorney before deciding who may testify or provide a statement.

A useful witness list for attorney review is more than a list of names. It should help the attorney understand who each person is, what they personally know, and how they could support a specific part of your case.

Start with everyone who may have firsthand knowledge

Include people who saw or heard an incident, knew about threats, saw injuries or changes afterward, know about your activities or identity, or can explain relevant family or background facts. Do not leave someone off merely because you are unsure whether the attorney will use them. Mark the uncertainty instead.

For each possible witness, record:

  • full name and relationship to you;
  • current country and safe contact method;
  • what the person personally saw, heard, or knows;
  • which incident or issue that knowledge relates to;
  • language the person speaks best;
  • whether the person may be available for a written statement or testimony;
  • any safety, immigration, privacy, or contact concern; and
  • documents, photographs, messages, or other evidence connected to that witness.

Keep facts separate from assumptions. For example, write “saw me after the hospital visit and saw the bandages,” rather than “can prove my entire case.”

Make the list easy to compare with your case

Use the same incident names or dates that appear in your master timeline. This lets an attorney quickly see which important events have independent witnesses and which do not.

A simple working table can use these columns: Witness | Relationship | Incident/topic | Personal knowledge | Language | Location | Contact status | Evidence connected | Questions for attorney.

Do not coach a witness or ask anyone to change a memory to match your application. If a witness remembers something differently, preserve that difference and flag it for attorney review. Your consistency review can help identify issues before a filing or hearing.

Attorney-review list versus a court witness list

This private preparation list is not necessarily the same document that will be filed with immigration court. EOIR has specific requirements for a court witness list, including the witness's name, A-number if applicable, a written summary of testimony, estimated testimony length, language, and a CV or résumé for an expert witness. Follow the court's requirements and your attorney's instructions before filing anything.
