What If I Cannot Safely Contact a Witness in My Home Country?

Safety comes before document collection

Contacting a witness may expose that person to a government agency, abusive person, criminal group, employer, family member, or digital surveillance. If there is a genuine safety concern, do not create a new risk merely because you think a statement would be helpful.

Record the concern privately and factually. Avoid posting the person's identity or contact information publicly.

Preserve what already exists

Keep existing messages, letters, photographs, or other records that show the person's relationship to you or what they may have personally observed. If you already have a prior statement, preserve the original and record when and how you received it.

Do not write a statement in the witness's name or sign for the witness. If you cannot contact the person, say that honestly.

Discuss alternatives with a qualified representative

USCIS guidance discusses corroborating evidence that is reasonably available. Whether a particular witness statement is necessary or reasonably obtainable depends on the circumstances.

A lawyer or DOJ-accredited representative can assess whether existing records, other witnesses, or an explanation of the safety problem should be considered. US Asylum Help does not decide what evidence must be obtained.

A practical way to organize this

Use a simple evidence index with columns for date, source, file name, short description, language/translation status, and where the original is stored. Keep uncertain information marked as uncertain. Do not change an original document to make it fit a timeline or another record.
