How to Prepare Witness Information for Attorney Review

Organize what each witness personally knows before asking a lawyer or accredited representative how a statement should be prepared.

A useful witness list is not simply a list of names. It tells the reviewer what each person actually knows and how they know it.

Create a witness summary first

For each potential witness, record:

  • full name;
  • relationship to you;
  • safe contact information, if appropriate;
  • language;
  • where the person is located;
  • what event or fact the person personally knows; and
  • how the person obtained that knowledge.

Separate personal knowledge from repetition

“Was present when X happened” is different from “heard me describe X later.” Both may be relevant to an attorney's review, but they are not the same type of knowledge.

Preserve supporting material

If the witness has photographs, messages, travel records, or other documents connected to what they know, list those separately rather than embedding everything into a long narrative.

Do not script a witness

A witness should provide truthful information in their own words. Your evidence organizer should identify what they know, not tell them what conclusion to reach.

Translation and interpretation may matter

If a declaration is prepared in English for someone who does not understand English, immigration-court rules include requirements concerning interpretation and certification. Have a qualified representative review the final format before filing.
